When Officer Harvey comes up to my car he says "you didn't have your seatbelt on when you turned on Washington from ahhhhhh Manheim." I was driving straight on Washington when I encountered officer Harvey. MANHEIM WAS 8 STREETS BEHIND ME? Plus Officer Harvey was on the Westbound side of Washington while I was traveling East. So unless he was just sitting in the left turn lane he would of been even farther back than 8 streets when I was at Manheim. When I crossed Bellwood Ave where I noticed Officer Harvey for the first time before he made a u turn and put on his lights, the light was green he had his left turn signal on but he was still behind the white line? I went back and looked that intersection is not one of those you can only turn left on a green arrow, so why hadn't he pulled out into the intersection to make the left? It was like he was waiting for me? SO HOW COULD OFFICER HARVEY SEE DOWN 8 STREETS AND THROUGH CARS TO SEE MY SEAT BELT WASNT ON IF I TURNED FROM MANHEIM ONTO WASHINGTON? When I went to court on Jan. 13th the first judge on the bench was probably the coolest most laid back judge EVER he started asking people what he thought they should do with there case he was laughing an smiling. He heard about 15 cases and I was about to go up when he stood up, and walked off the bench another Judge then got on the bench, oh no. This Judge was the complete opposite of the first Judge she was asking people why where they not using there turn signal BEFORE THE DEFENDANT EVEN PLEAD? She was assuming all these tickets were legit before I even got up there, and if you didnt say Here when she called you up and rush up there she was not happy when you got there. She called my name I said "PRESENT YOUR HONOR.... I'M COMMING, I'M COMMING, HERE I COME!" Not even a smile. She went to say something, she asked me my plea, and I said "your honor I need a continuance, as I have FOIA requested the body camera footage for each officer, the dashcam footage for each officer, and the dashcam footage for every vehicle Officer Harvey drove as a Bellwood Police Officer in the months of November and December 2019. Now they have 20 days to respond. I put in the request in on Dec. 27th and its Jan. 13th so they are on day 16, so..... She cut me off, with an over exasperated sigh and an eye roll. "Why don't you just wear your seat belt." In my mind I thought did she really just say that? I haven't even plead, if I'm gathering evidence the assumption of my plea should be obvious? So I said "Your honor I ALWAYS wear my seat belt, EVERYTIME I leave home.(REGAN VOICE) She smiled for the first time and said "well what about in your car" she was joking on the fact I said I wear it everytime I leave home. (Regan Voice) "Your honor I WOULD NOT THINK OF STARTING AN AUTOMOBILE WITHOUT MY SAFTEY BELT ATTACHED." She just looked at me for a second, then says "well what did the officer pull you over for?" "Your honor I would never be bold enough to speak to why another man does anything, he said I wasn't wearing my seat belt, but he also said I wasn't wearing it when I turned onto Washington and I NEVER TURNED ONTO WASHINGTON, so idk?"(Master Sgt Chilsen was about 4 feet away in my peripheral, officer Harvey was in the jurors box way behind me.) She paused and then said "Ok, there you go", and ripped open the plastic and handed me my license. She was quiet waiting for me to leave. I said "Ok your honor so how are we leaving this, so there are no misunderstandings? are you dismissing it, not guilty? What are we doing here?" In my head I'm thinking this should kinda be clear when I leave. "Case DISMISSED." "THANK YOU YOUR HONOR!" There really wasn't a doubt in my mind that I would win, it just depended on how long it took, and honestly even without figuring out how Ofc Harvey thought he saw me, I would have destroyed him on the stand. How is he gonna explain saying he saw me from 8 streets away. How is he gonna explain keeping my license. Ofc. Clark was there because HE put out a call over the radio. So if you called him to help you why would you not identify him? Why would he not identify. Cause I would have subpoenaed him in to. I would have made him explain what he meant by....Well we will save that for the next video of the body camera footage! Ofc Harvey is a rookie, as you will see on the bodycam footage he was completely unsure of himself, and me asserting my 5th ammendment right really got into his head. So much so Ofc. Clark told him....Well we will save that for the Body Cam footage also.
